Terms and Conditions

§ 1 – General / Validity 

These terms and conditions are based on all supplies and services by JOHANENLIES to customers. Deviating and / or supplementary agreements require the express written consent of JOHANENLIES. Consent by e-mail is sufficient.

 

§ 2 – Product Range and Conclusion of Contract

All offers by JOHANENLIES on our website or the platforms that we use are non-binding and subject to change.

Deviations and small technical changes in the products are possible in comparison to our illustrations or descriptions. In particular, we reserve the right to colour and grain differences in wood and fabric, to the extent that they are customary and in the nature of the materials used.

The selection of goods, conclusion of the contract and the contract execution are in the language of German.

The contract is concluded by the completion of the order process on the JOHANENLIES website (or the platforms used by us) and the receipt of the order confirmation from JOHANENLIES by e-mail, or by the execution of the order by JOHANENLIES.

None of the furniture available from JOHANENLIES is prefabricated. All furniture available from JOHANENLIES is produced according to the customer’s individual choice or determination. This also applies to products that the customer orders or purchases without changing the preset dimensions and / or materials (“Buy Now Products”). The default settings made by JOHANENLIES are only configuration suggestions; the customer adopts these as their own automatically if no other configuration changes are requested.

 

§ 3 – Prices and Terms of Payment
 

The prices that apply are those shown on the web pages of JOHANENLIES at the time of ordering.

All prices quoted are the total price in Euro and include the statutory sales tax at the current rate of 19 percent.

Shipping costs are subsequently calculated and added.

When placing an order, 100% prepayment of the final amount is required.

The customer chooses their preferred method of payment.

All orders are subject to a payment deadline: 10 days from the receipt of the contract confirmation.

A settlement of reciprocal claims is only possible with the express written consent of JOHANENLIES.

 

§ 4 – Delivery, Delivery Times and Shipping Costs

JOHANENLIES will deliver the goods within 10 weeks following the receipt of payment.

The delivery time may be delayed by up to 10 working days during the Christmas period and up to 5 working days during the Easter season. The shipping costs of the products(s) inside the shopping cart are announced to the purchaser before the order process is triggered.

Several products ordered simultaneously will be delivered in a single shipment, and in the case of a single shipment, the time required to deliver the product with the longest delivery time in the shipment shall apply to the whole shipment. If the customer wishes for the delivery of a specific product that has a shorter delivery time in advance, they must order this product separately.

If the delivery to the customer fails because the customer has given an incorrect or incomplete delivery address, another attempt at delivery will only be made if the customer immediately assumes the costs of the new shipment. These costs correspond to the shipping costs agreed upon conclusion of the contract.

If delivery to the customer fails because the customer is not present at the agreed time, a new delivery attempt will only be made if the customer immediately accepts the costs of the new shipment. These costs correspond to the shipping costs agreed upon conclusion of the contract.

If the customer has chosen cash payment then the goods will not be delivered. Instead, by arrangement through telephone agreement, the customer can pick up the goods from the supplier’s warehouse within 8 weeks from the conclusion of the contract; for individualised products (see section 2), the time to provision will be extended by 4 weeks.

Please examine the product(s) for obvious damage upon receipt, and in the presence of the shipping agent/forwarder. Possible damage must be recorded in writing, or the delivery agent must confirm the product as “damaged”. Hidden damage must be reported to us in writing within 7 days of the receipt of goods (email, letter or fax). We will contact the delivery service after receipt of the damage report. If necessary, an employee of the delivery service will examine or retrieve the package.

 

§ 5 – Consumer Right of Withdrawal
 

A purchaser who buys as a consumer is entitled to a right of withdrawal in accordance with the legal conditions. A consumer is any individual person who enters into a legal transaction for purposes which are predominantly attributable neither to a commercial nor to a self-employed professional activity.

 

§ 6 – Warranty 

The warranty is subject to legal regulations. For all defects occurring during the statutory warranty period of one year from delivery, which includes transport damage, you have the statutory right to subsequent remedy (a choice of defect removal or a new delivery) and – if the legal requirements are such – the statutory rights to a reduction or withdrawal as well as to compensation for damages. If the desired type of supplementary remedy is only possible with disproportionate costs, your claim is limited to the other type of supplementary remedy.
Note: For natural products such as real wood / veneering, appearances caused by the natural grain of the timber do not constitute a defect of the product.

 

§ 7 – Retention of Title

All deliveries are subject to retention of title. The delivered goods remain the property of JOHANENLIES until the purchase price has been paid in full.

 

§ 8 – Data storage / Data Protection 

Pursuant to §28 BDSG (Federal Data Protection Act), we draw your attention to the fact that the data required to undertake the transaction is processed and stored by means of a computer system in accordance with § 33 BDSG. All personal data collected from the customer will be treated confidentially. Only in the context of order processing (payment, shipping), will the necessary data be used by third parties. For data protection reasons, the reply can only be sent to the email address stored at * JOHANENLIES *.

 

§ 9 – Place of Performance and Jurisdiction


The place of performance is our place of business.

If the customer is a merchant and the contract is part of the operation of their commercial business, the place of jurisdiction for all legal disputes is our place of business. All legal relationships between us and the customer are governed exclusively by the law of the Federal Republic of Germany applicable to the legal relationships of domestic parties.

 

§ 10 – Severability Clause 

The nullity or invalidity of individual provisions of these terms and conditions does not affect the validity of the remaining provisions. Void or ineffective conditions are replaced by the statutory provisions.

 

§ 11 – Final provisions 

Should individual provisions of these terms and conditions prove to be ineffective or unenforceable, this shall not affect the validity of the remaining provisions.
